What Is the FMCSA Drug and Alcohol Clearinghouse?

The FMCSA Drug and Alcohol Clearinghouse is a secure federal database launched in January 2020 that contains records of drug and alcohol violations for CDL holders and other safety-sensitive transportation employees. It is maintained by the Federal Motor Carrier Safety Administration (FMCSA) and is required by 49 CFR Part 382, Subpart G.

Before the Clearinghouse, drivers with violations could simply change employers to avoid consequences. The Clearinghouse closes that loophole โ€” violations follow drivers nationwide, permanently linked to their CDL number.

What Information Is in the Clearinghouse?

The Clearinghouse contains records of:

  • Positive drug or alcohol test results
  • Refusals to submit to testing (including no-shows and adulterations)
  • Actual knowledge violations (e.g., employer saw driver using drugs)
  • Return-to-duty (RTD) test results
  • Follow-up testing completion
  • Negative RTD tests (indicating return to safety-sensitive duty)

Who Can See Your Clearinghouse Record?

  • Current employers โ€” Can run annual queries on all safety-sensitive employees.
  • Prospective employers โ€” Must query before hiring a CDL driver (with your consent for full queries).
  • FMCSA and enforcement agencies โ€” During audits and inspections.
  • State Driver Licensing Agencies (SDLAs) โ€” For CDL issuance and renewals.
  • You โ€” You have the right to see your own record at any time.

How Do Drivers Register?

  1. Go to clearinghouse.fmcsa.dot.gov
  2. Create an account using your CDL number and personal information
  3. Verify your identity via Login.gov
  4. Registration is free and takes about 10 minutes

Every CDL driver should register even if they have no violations โ€” you will be required to consent to employer queries, and employers cannot hire you without completing a Clearinghouse check.

Full vs. Limited Queries

Employers can run two types of queries:

  • Full query โ€” Provides complete violation details. Requires your electronic consent through the Clearinghouse portal before the employer can view results.
  • Limited query โ€” Returns only "violation" or "no violation" without details. Does not require your consent. Used for annual checks on current employees.

If a limited query returns "violation," the employer must then run a full query (with your consent) before taking any employment action.

How Long Do Violations Stay in the Clearinghouse?

Violations remain in the Clearinghouse for five years from the date of the violation โ€” or until the driver completes the return-to-duty (RTD) process and all follow-up testing, whichever is later. After this period, the violation is removed from query results but remains in the system for enforcement purposes.

Employer Obligations Under the Clearinghouse

Employers must:

  • Query the Clearinghouse before hiring any CDL driver
  • Run annual queries on all current safety-sensitive employees
  • Report all violations to the Clearinghouse within 3 business days
  • Report RTD completion and follow-up testing completion

Non-compliance can result in significant fines during FMCSA audits.

What Happens If You Have a Violation?

You must complete the Substance Abuse Professional (SAP) process before returning to safety-sensitive duties. This includes:

  1. SAP evaluation and assessment
  2. Completion of any recommended education or treatment program
  3. SAP follow-up evaluation
  4. Passing a return-to-duty drug/alcohol test
  5. Minimum 12 follow-up tests in the first 12 months (unannounced)
