Return to Duty Testing
DOT return to duty and follow-up drug testing per 49 CFR Part 40 — directly observed collection, MRO review, and FMCSA Clearinghouse reporting included. Available in all 50 states.
After a DOT drug or alcohol violation, federal law requires you to complete an evaluation with a DOT-qualified Substance Abuse Professional (SAP), finish the education or treatment program they prescribe, and receive their follow-up clearance before you can take the return to duty test.
Your return to duty test must be directly observed, and a negative result is required before you may resume safety-sensitive duties. After you return, your SAP prescribes a follow-up testing plan of at least 6 unannounced tests in the first 12 months.
