Why Random Testing Exists

Random drug and alcohol testing is one of the most effective deterrents in safety-sensitive transportation. Unlike pre-employment testing, random testing is unannounced โ€” the driver doesn't know until they're selected. This unpredictability is what makes it work. Federal regulations under 49 CFR Part 382 require all employers of CDL drivers to maintain a random testing program.

Annual Testing Rate Requirements

The FMCSA sets minimum annual testing rates that employers must meet:

  • Drug testing: At least 50% of your average driver count per year
  • Alcohol testing: At least 10% of your average driver count per year

Note: These minimums can be adjusted by the FMCSA based on industry-wide positive test rates. Rates have been reduced in the past when industry positivity dropped; always verify current rates with your C/TPA.

Selection Must Be Truly Random

Each driver in your pool must have an equal chance of being selected every time a draw is conducted. You cannot weight selections or pre-announce draw dates. Using a certified consortium takes this burden off your hands โ€” the random selection is computer-generated, documented, and defensible during an audit.

What Happens After Selection

  1. The employer (or C/TPA) notifies the selected driver immediately.
  2. The driver must report for testing within the same work day in most cases.
  3. The test is directly observed for drugs (urine collection) and uses a breathalyzer for alcohol.
  4. Results are reported to the employer via the MRO (Medical Review Officer) process.

A positive test, refusal to test, or adulterated/substituted specimen are all treated as violations and must be reported to the Clearinghouse.
